By accessing or using Incogni-Talk.com ("Incogni-Talk," "we," "our," "us"), you confirm that you are 18 years of age or older. You warrant that all information you provide is accurate, complete, and truthful. Accessing or using the platform constitutes agreement to these Terms. If you do not agree, you must not use the platform. We reserve the right to deny, suspend, or terminate access at any time for users who fail to meet these eligibility requirements or violate these Terms.

Incogni-Talk provides an online platform for anonymous conversations with random users. All content, communications, and interactions are user-generated. Incogni-Talk does not endorse, monitor in real-time, or control user activity. You acknowledge that interactions may include offensive, harmful, or illegal content, and you assume all risk associated with platform use. We make no warranties regarding the reliability, safety, suitability, or legality of user content or interactions.

You agree not to engage in harassment, threats, impersonation, illegal activity, sharing explicit content, interfering with the platform, attempting unauthorized access, or distributing harmful material. Sharing personal information of yourself or others is entirely your responsibility. Violations may result in immediate suspension, termination, and reporting to authorities. Incogni-Talk is not responsible for any consequences arising from your use of the platform or the actions of other users.

Incogni-Talk does not require usernames. Users control the personal information they share. Technical and operational data, including IP addresses, device information, browser type, cookies, and temporary logs of communications, may be collected to provide functionality, improve performance, ensure security, and comply with legal obligations. Users acknowledge that complete anonymity cannot be guaranteed and accept the risk of sharing information on the platform.

Certain features require account creation using an email address and password. Users are solely responsible for maintaining the confidentiality and security of their account credentials. Incogni-Talk is not responsible for unauthorized access, misuse, or compromise of your account. You must notify Incogni-Talk immediately of any suspected breach or unauthorized access. You accept all risk of loss, damage, or liability resulting from use of your account.

Premium features may be offered through recurring subscriptions. By subscribing, you authorize automatic billing at the beginning of each cycle until cancellation. Subscription fees, billing intervals, and available payment methods may change at Incogni-Talk's discretion. Incogni-Talk is not responsible for failed transactions, financial institution errors, chargebacks, or any third-party payment processing issues. Refunds are strictly governed by the Refund Policy, and no refunds are guaranteed beyond the limited exceptions specified.

Users are fully responsible for all content, messages, or material they generate or share on the platform. You acknowledge that other users may act unpredictably, engage in harmful behavior, attempt to solicit personal information, or post offensive content. Incogni-Talk assumes no responsibility for any harm, loss, or damages arising from interactions, including but not limited to emotional distress, reputational damage, or financial loss.

Incogni-Talk may suspend or terminate access, with or without notice, at any time and for any reason, including violations of these Terms, harmful or abusive behavior, or legal compliance. Termination does not entitle users to refunds, compensation, or any form of recourse, except as explicitly provided in these Terms. Users may discontinue platform use at any time, and Incogni-Talk has no further obligations.

The platform is provided "as is" and "as available." Incogni-Talk disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and accuracy of content. We do not guarantee the security, reliability, or functionality of the platform. Accessing or using the platform is entirely at your own risk.

To the fullest extent permitted by law, Incogni-Talk is not liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to damages arising from user interactions, exposure to offensive or illegal content, technical failures, service interruptions, data loss, network issues, third-party interference, or device malfunctions. Even if advised of potential damages, our liability is strictly limited to the lesser of the total amount you paid in the previous 12 months or USD $1. You agree to indemnify, defend, and hold harmless Incogni-Talk, its officers, directors, employees, and affiliates from any claims, losses, or expenses arising from your use of the platform, content you generate, or violation of these Terms.

All software, designs, graphics, logos, and branding belong to Incogni-Talk. Users may not reproduce, distribute, or exploit any platform intellectual property without prior written permission. Users retain ownership of their own content but grant Incogni-Talk a non-exclusive, worldwide, royalty-free license to host, display, distribute, and operate such content as necessary to provide the service.

Users agree that all disputes will be resolved exclusively in the competent courts of the corresponding jurisdiction. To the maximum extent permitted by law, users waive the right to participate in class action claims or consolidated proceedings against Incogni-Talk.

Incogni-Talk may revise these Terms at any time. Continued use after posting of updated Terms constitutes acceptance of those Terms.
